Operations · Lesson 1

Leasing and screening consistently

Begin with a property that is ready for lawful occupancy and a clear, accurate listing. Document rent, deposits, utilities, application procedures, and lease terms. Have local requirements and lease documents reviewed for your jurisdiction.

HUD explains that the Fair Housing Act prohibits housing discrimination on protected grounds. Build screening criteria that are appropriate, consistent, and reviewed for applicable federal, state, and local requirements. Do not assume a third-party scoring tool removes your responsibilities.

Keep a documented process for applications, notices, reasonable-accommodation requests, and decisions. Collect only necessary information and protect it. A resident relationship starts before the lease; clarity and fair treatment reduce avoidable conflict.

Worked example · Hypothetical

Two applicants submit similar information. If the owner changes standards for the second applicant without a legitimate documented basis, the process becomes inconsistent and difficult to defend.

Decision checklist

  1. Use accurate listings and documented application procedures.
  2. Review criteria, notices, and accommodation handling locally.
  3. Apply the process consistently and protect applicant information.
